Article 7: Subdivisio <br /> Section 7.3: Phasing of Major Subdivisions <br /> A tract of land in a Rural Designated area on the Growth Maria.- ent System <br /> map that is proposed fora subdivision of 21-40 lots. <br /> (3) Major Subdivision, Class A Special Use, Urban D- ignated <br /> A tr.. of land in an Urban Designated area o. e Growth Management System <br /> map tha .roposed for a subdivision of -79 lots. <br /> (4) Major Subdivis : I Conditional e, Rural Designated <br /> A tract of land in a Rura -: gnated area on the Growth Management System <br /> map that is proposed f.-a s .:ivision of 41 or more lots. <br /> (5) Major Subdivis-: , Conditional U = Urban Designated <br /> A tract of :nd in an Urban Designated area . the Growth Management System <br /> map -at is proposed for a subdivision of 80 or - lots. <br /> (B) For th= surpose of determining whether a subdivision is a Major bdivision, Class A <br /> S.-cial Use (Rural Designated or Urban Designated), or a Major Su.:. ision, Conditional <br /> se District (Rural Designated or Urban Designated), the number of lots c :.ted shall be <br /> determined by counting the cumulative number of lots created, through subdivi s, on a <br /> tract or parcel of land as the boundaries of said tract or parcel of land existed in the d <br /> Records of Orange County as of November 5, 2003. <br /> SECTION 7.3: HASING OF SUBDIVISIONS <br /> A major subdivision may be developed in phases, provided that: <br /> (A) Each phase contains at least five lots, unless depicted on a phasing plan approved by the <br /> Board of County Commissioners as part of the preliminary subdivision plat with the <br /> express determination that the proposed phasing makes it unlikely that a subdivider <br /> would willingly abandon a final phase that contains a required extension of a road or <br /> other infrastructure; <br /> (B) The degree and extent of road, water supply, sewage disposal, stormwater management, <br /> erosion and sedimentation control, and other required improvements in the phase and <br /> previously approved phases is sufficient to serve or handle all development within the <br /> phase; <br /> (C) The number of lots and amount of 100% of required open space in the phase and any <br /> previously approved phases is proportionalshall be dedicated with the recordation of the <br /> first lot; and <br /> {C-)(D) A phasing plan showing the phases of development and the requirements of this <br /> Ordinance that will be satisfied in each phase is approved by the Board of County <br /> Commissioners as part of the preliminary plat. <br /> A minor subdivision utilizing the Flexible Development Option may be developed in phases, provided that: <br /> (A) The degree and extent of road, water supply, sewage disposal, stormwater management, <br /> erosion and sedimentation control, and other required improvements in the phase and <br /> previously approved phases is sufficient to serve or handle all development within the <br /> phase; <br /> (B) 100% of required open space shall be dedicated with the recordation of the first lot; and <br /> {D}(C) A phasing plan showing the phases of development and the requirements of this <br /> Ordinance that will be satisfied in each phase is approved by the Planning Director as <br /> part of the final plat. <br /> Orange County, North Carolina—Unified Development Ordinance Page 7-3 <br />
