Article 7: Subdivision <br /> Section 7.2: Classification of Subdivisions <br /> 7.2. Exempt Subdivisions <br /> (A) In accordance with North Carolina General Statutes, the following activi do not <br /> ■ stitute a subdivision and are expressly exempt from established iew and approval <br /> proc- es, provided that the property's exempt status is confir r . in accordance with <br /> the proceb res detailed in Article 2: <br /> (1) The co ation or recombination of portio _ of previously subdivided and <br /> recorded lot the total number of lots of increased and the resultant lots are <br /> equal to or excee. e standards o e County, including private road <br /> justification standards, deta. -: within this Ordinance. <br /> (2) The division of land into s.rc- greater than ten acres if no street right-of-way <br /> dedication is involv-s. <br /> (3) The public a s isition by purchase of str b of land for widening or opening <br /> streets. <br /> (4) Ts division of a tract in single ownership of the enti .rea of which is no greater <br /> than two acres into not more than three lots, if no street r it-of-way dedication is <br /> involved and if the resultant lots are equal to or exceed the st.•cards of the <br /> County as detailed within this Ordinance. <br /> :) Exempt subdivision shall be required to meet all applicable requirements for the . ting <br /> of zoning and building permits. <br /> 7.2.2 Minor Subdivisions <br /> A subdivision shall be classified as "minor" if it does not: <br /> (A) Create more than <br /> (1) Wive lots, including the residual acreage, following the Conventional subdivision <br /> design model; or <br /> 44}(2) Twkelve lots, including the residual acreage, following the Flexible Development <br /> subdivision design model from any one tract of land in any ten year period.-17 <br /> (B) Dedicate or improve any new public street other than widening an existing public street; <br /> (C) Extend public water and/or sanitary sewerage systems other than laterals to serve <br /> individual lots; and <br /> (D) Necessitate the installation of drainage improvements which would require easements <br /> through one or more lots to serve other lots. <br /> 7. .' ajor Subdivisions <br /> (A) A -.'.r subdivision is any subdivision that is not an Exempt or •. subdivision, as <br /> classified i _ 'sections 7.2.1 and 7.2.2. Major subdivi - are further classified as <br /> follows: <br /> (1) Major Subdivision, Stoner:- <br /> All subdivision classified as an Ex- Subdivision; Minor Subdivision; <br /> Major _..ivision, Class A Special Use; or Majo _ 'division, Conditional Use. <br /> (2 Major Subdivision, Class A Special Use, Rural Designates <br /> 17 As proposed by staff there will be different thresholds for what constitutes a minor subdivision based on the <br /> design process followed by the subdivider.
