39 <br /> is authorized to execute this certificate in the name of and on <br /> behalf of the County. <br /> Based on the aforesaid examination and investigation, the <br /> undersigned does HEREBY CERTIFY as follows: <br /> 1. No proceeds of the Facility are to be used for any <br /> private business purposes, nor will the payment of principal or <br /> interest on the proceeds of the Facility be (i) secured by any <br /> interest in property used or to be used for a private business use <br /> or payments in respect of such property, or (ii) derived from <br /> payments in respect of property or borrowed money, used or to be <br /> used for a private business use. Further, no part of the proceeds <br /> of the Facility are to be used to make or finance loans to persons <br /> other than governmental units. <br /> 2 . The County is or will be the owner and the operator of <br /> the improvements the construction of which is financed by the <br /> Facility (the "Property" ) . There will be no other "principal user" <br /> (within the meaning of the Internal Revenue Code of 1986, as <br /> amended (the "Code") and the regulations promulgated thereunder] of <br /> the Property. <br /> 3 . The County hereby designates the Facility for purposes of <br /> paragraph (3) of Section 265 (b) of the Code and certifies that the <br /> Facility is not intended to constitute a private activity bond as <br /> defined in Section 141 of the Code. The County further certifies <br /> that it does not currently anticipate that it (and all subordinate <br /> entities thereof) will issue, in an aggregate principal amount, <br /> more than $10, 000, 000 . 00 of obligations the interest on which is <br /> 18 <br />
