relative locations of the well, septic system and structure maximize the amount of <br /> watershed shed protection that can be achieved while allowing development of the <br /> lot. Generally, an exception to setbacks for repair area is preferable to an exception <br /> for the initial septic system,and encroachment of structures or gravity septic systems <br /> into the setback is preferable to the installation of a septic system pump. <br /> 5. The amount of encroachment into the stream or reservoir buffer is the minimum <br /> amount which can be obtained while meeting the above criteria. <br /> 6. All of the above criteria are met and the lot is located adjacent to a water supply <br /> reservoir, and Orange County Environmental Health has determined that there are <br /> no existing water quality problems in that reservoir which can be attributed to <br /> malfunctioning septic systems within 300 feet of the normal pool elevation. <br /> 6.23.11 ADMINISTRATION <br /> a) Appeals <br /> Decisions of the Zoning Officer and County Engineer in the implementation of this Article <br /> may be appealed to the Orange County Board of Adjustment in accordance with Article 2.3.7 <br /> of this Ordinance. <br /> b) Variances <br /> Development activities may be granted minor variances by the Board of Adjustment in <br /> accordance with Article 2.3.6 of this Ordinance. <br /> A variance which results in one or more of the following shall be considered a major <br /> exemption, requiring approval by the Environmental Management Commission. <br /> 1. the complete waiver of a management requirement; <br /> 2. the relaxation by more than ten percent of any management requirement that take° <br /> the form of a numerical standard; and <br /> the relaxation of any management requirement that takes the form of a numerical <br /> standard to less than 90% of the minimum required by State mandate. <br /> 3. the relaxation of any management requirement that applies to a development project <br /> requiring construction of a BMP. <br /> A description of each project receiving a variance and the reason for granting the variance <br /> shall be submitted to the Commission on an annual basis. <br /> All other local governments having jurisdiction within the watershed area and the entity using <br /> the water supply for consumption shall be notified of the proposed exemption. <br /> ********************************** <br /> ORDINANCE REVIEW SUBCOMMITTEE: October 10, 1994 <br /> PLANNING BOARD REVIEW: <br /> BOCC REVIEW: <br /> 8 <br />
