Due to subsequent comments from the <br /> Attorney's office,staff is suggesting the language remain as is because of concerns related to the recent Byrd v. Franklin County judicial decision. This language <br /> may be modified at a later date as staff is currently working on comprehensive amendments to the Tables of Permitted Uses to address the outcome of the <br /> referenced judicial decision. Due to comments made at the September 12, 2016 quarterly public hearing,the Manufacturing sectors, as they pertain to the <br /> proposed EDH-5 addition,were suggested for further refinement. Because of this,the Attorney's office has suggested that a portion of the comprehensive <br /> work to the Table of Permitted Uses be undertaken at this time. Therefore, manufacturing uses pertaining to the Buckhorn and Eno EDDs are also proposed to <br /> be revised. At this time,staff is proposing use of the NAICS codes to achieve this work.
