082 <br /> 4 <br /> Industrial Activity Node. <br /> - Dalton Riley, property owner of two acres on <br /> US 70 adjoining the Hunter property, indicated <br /> he was opposed to the node expansion. <br /> On the day of the public hearing Mr. Riley came to <br /> the office and spoke with Brad Torgan regarding <br /> the proposed expansion of the node in the Draft <br /> plan for Cheeks Township. He attended the hearing <br /> and spoke against the node expansion. <br /> As follow-up to the hearing, Mrs. Riley came by <br /> the office and asked if a petition of opposition <br /> might strengthen the case against expansion of the <br /> node. She was informed that petitions were very <br /> effective, but that technically, the Planning <br /> Board could not consider a petition in formulating <br /> their recommendation since it was not presented at <br /> the public hearing. This was based on the County <br /> Attorney's opinion of 2/13/86. She said that a <br /> petition would have been presented at the hearing <br /> if she and other residents had known of the <br /> request more than two days before the hearing. <br /> Mrs. Riley did elect to compile a petition and <br /> turned a copy in to the Planning Department on <br /> 6/3/88. This was followed on 6/9/88 by a letter <br /> from Mr. Riley which expanded upon his comments at <br /> the public hearing. <br /> The Board was made aware of this because a <br /> substantial number of the property owners who <br /> signed the petition were in attendance at the <br /> Planning Board meeting. Copies of the petition, <br /> letter, and a map identifying the property <br /> • holdings of petitioners were available but the <br /> Board did not elect to consider them since they <br /> were not part of the public hearing testimony. <br /> This was explained to members of the audience by <br /> the Chair. <br /> The Planning Staff recommends approval of the <br /> amended text and map and incorporation into <br /> Section 3.8 of the Land Use Element of the Orange <br /> County Comprehensive Plan. <br /> In reference to the citizen petitions for node <br /> expansion, staff recommends: <br /> - Further analysis of the Davis request and <br /> presentation at the August public hearing. The <br /> subject property lies approximately 1,250 feet <br /> from the existing node and many intervening <br />
