AMMON <br /> r . 152 <br /> that failure of the Orange County Board of Commissioners to <br /> approve this agreement and appropriate the necessary funds for <br /> execution of the provisions and conditions of this agreement <br /> shall void this agreement and that neither party shall have any <br /> further obligations under this agreement. <br /> 7. The party of the second part agrees that it will <br /> provide a means of access over and across the above-described <br /> property to be received by it from the parties of the first part <br /> as well as other properties to be purchased by the party of the <br /> second part to provide for personal and private access for the <br /> parties of the first part to other lands owned by the parties of <br /> the first part; said access shall be in the nature of a profit a <br /> prendre and shall not be assignable or transferable, either by <br /> deed, devise or decendency from the parties of the first part to <br /> any other party. The party of the second part agrees that such <br /> access will be provided across its now or future property as <br /> aforesaid in such a manner as to provide a reasonable means of <br /> access to other properties owned by the <br /> P P y parties of the first <br /> part, such access shall not in any way inhibit the use of the <br /> property of the party of the second part for school purposes. <br /> 8. The party of the second' part agrees that it will <br /> maintain a natural-state buffer of at least twenty-five (25) feet <br /> along the property lines of its property adjoining property <br /> belonging to the parties of the first part; natural-state buffer <br /> to be defined as an area of natural trees and other vegetation <br /> indigenous to this area of the State of North Carolina. <br /> 4 <br />
