• <br /> 143 <br /> (b) That the Buyer will purchase the entire tract of land and <br /> may subdivide said property, provided that no subdivision <br /> of said property will include any road frontage whatsoever <br /> on N.C. 86, which said road frontage shall be retained by <br /> the Buyer, or its successors in title; or <br /> (c) That the Buyer may purchase less than the above-described <br /> tract, leaving a lot no less than two acres nor no more <br /> than three acres to be retained by the Seller, which said <br /> retained lot shall contain the entire road frontage on <br /> N.C. 86. If this option is selected by the Seller, Deed <br /> conveying the premises from the Buyer to the Seller shall <br /> contain the restriction that the Buyer or its successors <br /> in title, will not subdivide said property, or sell any of <br /> the road frontage on N.C. 86. <br /> The Buyer shall have the option to choose any one of the above <br /> stipulations that most nearly suits its needs, provided that the <br /> Buyer must choose one of the above stipulations to be set forth in <br /> the Deed of Conveyance from the Sellers to the Buyer. <br /> 7. The Sellers and the Buyer acknowledge and agree g g that the <br /> Agreement for the Purchase and Sale of Land is subject to approval <br /> by the Orange County Board of Commissioners on or before thirty (30) <br /> days from the date hereo f. The parties acknowledge that failure of <br /> the Orange County Board. of Commissioners to approve this Agreement <br /> and appropriate the necessary funds to pay the sums set forth herein <br /> shall void the same and that neither party will have any further <br /> obligations under this Agreement. <br /> 8. There must be no restrictions, easements, zoning or other <br /> governmental regulations which would prevent the reasonable use of <br /> 4 <br />
