Box 8181 <br /> Hillsborough, NC 27278' <br /> Dear Mr. Link: <br /> Re: Disposition of Property <br /> You will recall we have discussed with the Orange County Board of <br /> Commissioners the disire.of the Board of Education to dispose of a lot <br /> located on West Union Street, across from the A. L. Stanback Middle <br /> School. At the most recent discussion with the Commissioners on this <br /> issue, the Commissioners took no action and requested that we re-examine <br /> the subdivision approach to get more lots than what was proposed. We <br /> have re-examined the situation and submit this for reconsideration. <br /> You will need to reference the attachments, which are as follows: <br /> Attachment A - Letter from Board Attorney Mike <br /> Parker on the zoning review <br /> and requirements. <br /> Attachment B - A map showing the existing lots <br /> (B-1) and nonconforming sub- <br /> divisions (B-2). <br /> Attachment C - The proposed subdivision which <br /> would allow the Board of Education <br /> to dispose of the new lot 1. <br /> The substance of the review is that the re-subdivision of the <br /> existing lots (B-1) can only occur under Town zoning ordinance as <br /> outlined in the resolution and depicted on Attachment C. If we were <br /> to attempt the subdivision as outlined in B-2, the new lot A would be <br /> nonconforming even with the inclusion of the small acreage currently <br /> owned by the Mebane Chapel Holiness Church. <br /> Furthermore, given the fact that the church facility is so close to <br /> the property line, I can never anticipate that the Board of Education <br /> would use the land immediately adjacent to the small church lot; therefore, <br /> it would seem to me to be expedient for the Board to dispose of the lot <br /> in the manner so described in the resolution forwarded earlier and as <br /> outlined on Attachment C. <br />
