. 075 <br /> • <br /> w <br /> • <br /> requirements of NRCD, all applicable requirements of the General Statutes of <br /> the State of North Carolina and any other applicable laws and Executive <br /> Orders currently or hereafter in force. <br /> 3. Obligations of Recipient with Respect to Certain Third Party <br /> Relations. NRCD shall hold the recipient responsible for complying with the <br /> provisions of this agreement even when the recipient designates a third <br /> party or parties to undertake all or any part of the program. The recipient <br /> shall comply with all lawful requirements of NRCD necessary to ensure that <br /> the program is carried out in accordance with the recipient's certifi- <br /> cations, including the certification of assumption of environmental <br /> responsibilities, under Rule .0601 of the North Carolina Emergency Shelter <br /> Grants Program Administrative Rules, 15 NCAC 13P. <br /> 4. Interest of Members, Officers, or Em.lo.ees of the Recipient, • <br /> Members of Local Governing Body, or Other Public Officials. No member, <br /> officer, or employee of the recipient or its agents, no member of the <br /> governing body of the locality in which the program is situated, and no <br /> other public official of such locality or localities who exercises any <br /> functions or responsibilities•with respect to the program during his tenure <br /> or for one year thereafter, shall have any financial interest, either direct <br /> or indirect, in any contract or subcontract, or the proceeds thereof, for <br /> work to be performed in connection with the program assisted under this <br /> • agreement. Immediate family members of said members, officers, employees, <br /> and officials are similarly barred from having any financial interest in the <br /> program. The recipient shall incorporate, or cause to be incorporated, in <br /> all such contracts or subcontracts, a provision prohibiting such interest <br /> pursuant to the purposes of this section. <br /> The assistance provided under this agreement shall not be used in the <br /> payment of any bonus or commission for the purpose of obtaining NRCD approval <br /> of the application for such assistance, or NRCD approval of applications for <br /> additional assistance, or any other approval or concurrence of NRCD required <br /> under this agreement or the North Carolina Emergency Shelter Grants Program <br /> Administrative Rules, with respect thereto; provided, however, that <br /> reasonable fees for bona fide- technical, consultant, managerial other <br /> er. if <br /> such services, other than actual solicitation, are not thereby p rorio <br /> otherwise eligible as program costs. <br /> • <br /> 5.. Remedies. NRCD shall have grounds to carry out the actions <br /> described in 15 NCAC 13P .0604 REMEDIES when it determines that program <br /> goals and objectives have not been met, that state or federal require- <br /> ments have not been followed, or that grant funds have been improperly <br /> • expended. <br /> 6. Access to Records Related to ESGP Activities. The recipient • <br /> will give NRCD, HUD and the.Comptroller General, through any authorized <br /> • representatives, access to and the right to examine all records, books, <br /> papers or documents related to the ESGP grant and will require the <br /> subrecipient(s) to provide the same access to and the right to examine its <br /> records, books, papers or documents related to the ESGP grant. <br /> • <br /> • <br /> ESGP #118-2 (Revised 5/88) <br />
