- • 098 <br /> 10 NCAC 10G; SOLID WASTE MANAGEMENT; has been adopted as follows ; <br /> SECTION .0100 - GENERAL PROVISIONS <br /> .0101 DEFINITIONS <br /> The following definitions shall apply throughout this Subchapter: <br /> (1) "Airport" means public-use airport open to the public without <br /> prior permission and without restrictions within the physical <br /> capacities of available facilities. <br /> (2) "Blood products" means all bulk blood and blood products. <br /> (3) "Cell" means compacted solid waste completely enveloped by a <br /> compacted cover material. <br /> (4) "Disposal" means the discharge, deposit, injection, dumping, <br /> spilling, leaking, or placing of any solid waste into or on <br /> any land so that such solid waste or any constituent thereof <br /> may enter the environment or be emitted into the air or <br /> t1cuharged into any water, including groundwaters. <br /> 5) re • on an i ,-ans : 1 ary - - <br /> limited to receiving stumps, limbs, leaves, concrete, brick, <br /> wood, uncontaminated earth or other solid wastes as approved <br /> .v • - .~ ' sion. <br /> "Division" mean t e director of the division of health <br /> services or his authorized representative. <br /> (7) "Explosive gas" means Methane (CH4) . <br /> (8) "Federal act" means the Resource Conservation and Recovery <br /> Act of 1976, P.L. 94-580, as amended. <br /> (9) "Floodplain" means the lowland and relatively flat areas <br /> adjoining inland and coastal waters, including flood-prone <br /> areas of offshore islands, which are inundated by the <br /> 100-year flood. <br /> (10) "Garbage" means all putrescible wastes, including animal <br /> offal and carcasses , and recognizable industrial by-products , <br /> but excluding sewage and human waste. <br /> (11) "Hazardous waste" means a solid waste, or combination of <br /> solid wastes, which because of its quantity, concentration, <br /> or physical, chemical or infectious characteristics may: <br /> (a) cause or significantly contribute to an increase in <br /> mortality or an increase in serious irreversible or <br /> incapacitating reversible illness ; or. <br /> (b) pose a substantial present or potential hazard to human <br /> health or the environment when improperly treated, stored, <br /> transported, or disposed of, or otherwise managed. <br /> (12) "Hazardous waste facility" means a facility for the storage, <br /> • <br /> collection, processing, treatment, recycling, recovery or <br /> disposal of hazardous waste. <br /> (13) "Hazardous waste landfill facility" means any facility or any <br /> portion of a facility for disposal of hazardous waste on or <br /> in land in accordance with rules promulgated under this <br /> article. <br /> (14) "Incineration" means the process of burning solid, semisolid <br /> or gaseous combustible wastes to an inoffensive gas and a <br /> residue containing .little or no combustible material. <br />
