249
ORANGE COUNTY
BOARD OF COMMISSIONERS
ACTION AGENDA ITEM ABSTRACT
Meeting Date June A, 1988
Action Agenda
Item #
SUBJECT: REQUEST TO INITIATE LEGAL ACTION - DWIGHT WAGONER
ACTION BY: June 6, 1988
DEPARTMENT: PLANNING PUBLIC HEARING Yes _x_No
ATTACHMENT(S) : INFORMATION CONTACT: Don Powell
Complaint/Inquiry Record
Certified Letters to Mr. Wagoner
Vicinity Map
Zoning Ordinance Provisions
Photographs
TELEPHONE NUMBERS:
Hillsborough - 732-8181
Durham - 688-7331
Mebane - 227-2031
Chapel Hill - 968-4501
PURPOSE: Consideration of a request to initiate legal
proceedings against Dwight Wagoner, Route 2, Box 766,
Hillsborough, NC 27278. The property in violation is
on NC Highway 86 North in Hillsborough Township (TMP
Ref 4.3. .23) and consists of approximately 4 acres
zoned AR (Agricultural Residential) . Property is
owned by John Wagoner, father of Dwight Wagoner.
BACKGROUND: Dwight Wagoner erected a sign on property of his
father shortly prior to February 23, 1988. Said sign
is in violation of Orange County Zoning Ordinance
Section 9.11 (Permitted Sign Table) . Initial contact
was made on February 24, 1988 with Mrs. Wagoner,
Dwight Wagoner's stepmother, giving notice of
violation. An office visit by Dwight Wagoner on
February 25, 1988 affirmed sign violation and
conditions for sign removal. Two certified letters
were mailed to Dwight Wagoner (March 16, 1988 and
April 21, 1988) with no results. Site check on May 2,
1988 confirmed sign remains in place and in violation
of ordinance.
RECOMMENDATION: The Administration recommends initiation of legal
proceedings against Dwight Wagoner.
