[n\ 3‘ RUS The applicant indicated in a letter that the length of time needed to obtain all State and local permits will exceed the deadline of July 6, 1988. The Planning Board considered this request on February 15, 1988. The following questions arose regarding the request, because the developer intends to use a community, low- pressure wastewater disposal system for sewage disposal: 1. Can the Planning Board delay action on the request pending receipt of the results of the Alternative Systems Study requested by the Board of Commissioners? 2. Can the Planning Board refer the Flowers request back to public hearing for reconsideration depending upon the results of the Alternative Systems Study? The County Attorney indicated that the Zoning Ordinance does •not allow reconsideration of any element of the permit other than the time extension itself. The time extension should be either approved or denied. If approved, the time limit would be extended to January 6, 1989. The applicant would have to resubmit an application if construction had not started and proceeded at a reasonable rate as required by Section 7.2.8 of the Zoning Ordinance. If denied, the permit would expire on July 6, 1988. The County Attorney recommends that since the request for an extension of time was made in February, the Planning Board should make its recommendation promptly and forward that to the Board of commissioners. Written response from the County Attorney will be distributed when available. The Planning Staff recommends approval of the time extension. MOTION: Yuhasz moved approval. Seconded by Eddleman.
