[n\ 3‘ RUS <br /> The applicant indicated in a letter that the <br /> length of time needed to obtain all State and <br /> local permits will exceed the deadline of July 6, <br /> 1988. <br /> The Planning Board considered this request on <br /> February 15, 1988. The following questions <br /> arose regarding the request, because the <br /> developer intends to use a community, low- <br /> pressure wastewater disposal system for sewage <br /> disposal: <br /> 1. Can the Planning Board delay action on <br /> the request pending receipt of the results <br /> of the Alternative Systems Study requested <br /> by the Board of Commissioners? <br /> 2. Can the Planning Board refer the Flowers <br /> request back to public hearing for <br /> reconsideration depending upon the results <br /> of the Alternative Systems Study? <br /> The County Attorney indicated that the Zoning <br /> Ordinance does •not allow reconsideration of any <br /> element of the permit other than the time <br /> extension itself. The time extension should be <br /> either approved or denied. If approved, the time <br /> limit would be extended to January 6, 1989. The <br /> applicant would have to resubmit an application <br /> if construction had not started and proceeded at <br /> a reasonable rate as required by Section 7.2.8 of <br /> the Zoning Ordinance. If denied, the permit <br /> would expire on July 6, 1988. <br /> The County Attorney recommends that since the <br /> request for an extension of time was made in <br /> February, the Planning Board should make its <br /> recommendation promptly and forward that to the <br /> Board of commissioners. Written response from <br /> the County Attorney will be distributed when <br /> available. <br /> The Planning Staff recommends approval of the <br /> time extension. <br /> MOTION: Yuhasz moved approval.
