Proposed Subdivision PRIVATE ROAD JUSTIFICATION Because of the Nature and Location of this Proposed Subdivision, and Given the Facts Listed, We feel that a Private Road is Justified. 1. The Location of the Proposed Subdivision is in an Area of Agricultural/ ' Residential Usage Where most of the Existing Surrounding Subdivisions are on Private Roads, Many of Which are Substantially Larger Parcels - Containing Smaller Lots. 2. The Topography of this Tract is Rolling and Contains Beautiful Mature Chestnut Oak Trees, Which if a Public Road is Mandated, Would Certainly Detract from the Aesthetics of the Area. This is Because of the Minimum Curve Radius and Horizontal Alignment Standards the D.O.T. Requires in • order to take over the Road. In a Meeting with the D.O.T., it.was Dis- cerned that this Proposed Subdivision Just Barely met the Density Regu- irements of the State to Take it Over Once Completed. 3. Also Given the Topography, and the Only Logical Road Placement, Much More Cut and Fill Would be Required that necessary With a Private Road. Given that There Can Only be a Maximum of 14 Homes ever Built Fronting on this Road and With a Creek Located at the Basin of the Tract, it • Seems Only Sensible to Thwart as Much Erosion as Possible. 4. It will be Written. into the Covenants that No Further Development can be Allowed Beyond the Tract than Proposed, and no extensions to the ' Road May Ever be Built. • 5. The Road to be Built Will in Fact Meet Class "B" Standards, and will Provide Adequate Public use for Owners and Public Safety Vehicles. It Will Also be Covered by a "Road Maintenance Agreement" to be Recorded Prior to First Phase of the Subdivision Being Recorded. • See Page Two.
