170
L:\ j 14
30-foot drainage easements would be necessary in
certain locations, and that a detention pond
would be necessary to control the peak rate of
runoff for the ten-year storm to the
predevelopment rate. Mr. P`aircloth has also
recommended discussion of the erosion control
plan with the developer prior to plan approval.
All of these comments have been attached as
conditions of approval.
The Orange County Health Department has not found
any suitable areas for septic tank disposal on
lots 26, 27, and 28.
The Planning Staff recommends approval of the
preliminary plan for Oak Crest Subdivision with
the acceptance of 5.86 acres of recreation/open
space and the following conditions:
1. Provide restrictive_povenants for review by
the County Attorney which include a
prohibition on further subdivision of the
thirty-eight (38) lots shown on the
preliminary plan as well -as provisions for
maintenance of drainage easements and
•
stormwater detention facilities.
2. Approval of the access easement agreement
with accompanying plat by the County
Attorney.
3. Provide a warranty deed to Orange County for
the 5.86 acres of recreation/open space in
the format recommended by the County
Attorney.
4. Continue the 30 foot wide drainage easement
shown on sheet 3 along the drainage ways
through lot 11. All easements must be shown
on the final plat.
5. Include in the stormwater management plan
provisions to control the peak rate of runoff
for the 10-year storm to the predevelopment
rate.
6. Provide a registered engineer's calculations
and certification that proposed improvements
to the road crossing at Price's Creek will
not decrease the flood carrying capacity of
the stream.
7. Provide a note on the final plat which
restricts access of lots 19, 20, 21, and 22
