The right of way width of the Stubout <br /> shall be 50 feet in width, as required by the Department of <br /> Transportation Specifications referenced above. <br /> 3 . Upon completion of the construction of the roadway over <br /> the Roadway Easement and the Stubout, Purchaser shall clean up <br /> and restore the Easement Property to its natural state as it <br /> existed prior to the commencement of construction including: ( 1) <br /> clearing the Easement Property of the debris resulting from the <br /> construction, and ( 2) grading and seeding all areas within the <br /> Easement Property disturbed by such construction; provided, <br /> however, that the parties understand and agree that the pond <br /> located on lot 33 of Exhibit F shall be affected by the <br /> construction of the Stubout and that the requirements of the <br /> Department of Transportation shall determine the extent to which <br /> the pond may be restored, and nothing herein shall obligate the <br /> Purchaser to perform any restoration that is contrary to the <br /> Department of Transportation Specifications referenced in <br /> provision 2 hereof; and further provided that Purchaser shall not <br /> Be. required to restore any trees which may be cut within the <br /> . Roadway Easement or the .60 foot wide construction easement for <br /> the Stubout. • <br /> 4 .
