• 1.11
12
property is zoned Residential-1, and the Land Use
Plan designation is Rural Residential. All lots
are proposed to be served by individual wells
and septic tanks. The Rural Residential
designation in the Land Use Plan indicates this
area is suitable for low density residential
development that would not require urban-type
services.
All agencies have reviewed the preliminary plan
for Phase Three Eagles Chase.
The Planning Staff recommends approval of the
preliminary plan subject to the following
condition:
1. Designate the 50-foot reserved right-of-way
extending from the cul-de-sac on Jacobs Trail
to the eastern property line as a private 50-
foot reserved right-of-way. The future
extension of Jacobs Trail will require that
the right-of-way in the cul-de-sac (above
that required for a 50 foot right-of-way) be
incorporated into lots 21, 22, and 23.
Jacobs asked how Kirk knew this was the final
phase of the subdivision. Kirk responded that the
developer had indicated this was the final portion
of the lot in his ownership.
Pilkey expressed concern with a public road ending
in a private cul-de-sac. Kirk responded that if
the property behind Eagles Chase Phase III was
developed in the future, the developer of the
adjoining property would have to purchase
easement rights.
Eddleman asked if the Planning Staff felt that
the property behind Eagles Chase could become
landlocked. Collins responded that that was not
justification for providing right-of-way through
the property. He continued, noting that if there
was a need for a collector road being extended
it could be required. Collins said that in the
past, the recommendation had been for a
reservation aflsnd for possible future right-of-
way. The difference would be the notation on the
plat regarding the cul-de-sac.
Eddleman asked about the stream buffer. Kirk
indicated that the stream was actually on property
to the south and that the Erosion Control Officer
had requested only a drainage easement.
