Garrett <br /> Orange County Planniug,Department <br /> 106 Bast Margaret Lane <br /> Hillsborough, NC 27278 <br /> Dear Ms. Garrett: <br /> In response to your letter of December 22, 1986, when I attempted <br /> to investigate this area indicated on Tax Map 45 in the Cedar Grove Township, <br /> I found the road blocked and, therefore, could not review the condition of the <br /> dam. <br /> Actually, it is the policy of the Division of Highways to discourage <br /> the location of roadways on dams. However, in certain cases where a definite <br /> advantage is gained, a dam may be utilized as a roadway provided the following <br /> criteria is met: <br /> 1 . The dam must have certification from the N. C. Department <br /> of Natural Resources and Community Development pursuant to <br /> the "Dam Safety Law of ]967" (amended 1977). <br /> 2. All pertinent data regarding the design of the embankment <br /> as an impoundment structure must be presented to the <br /> Division of Highways for review. <br /> 3. The top cross section dimension must be the roadway width <br /> required (shoulder point to shoulder point) plus a mini- <br /> mum of four (4) feet. <br /> 4. Guardrail will be provided on the impoundment side of the <br /> roadway. If a safety hazard exists, then guardrail may be <br /> required on both sides of the roadway. <br /> 5. The spillway will be designed to provide two (2) feet of <br /> freeboard at the shoulder for an estimated 50-year design <br /> frequency outflow as a minimum. <br /> An Equal Opportunity/Affirmative Action Employer <br />
