U6u <br /> study and provide recommendations concerning measures to <br /> safeguard the Lake Orange dam structure and spillway, <br /> including but not limited to, fencing to prevent public <br /> access. <br /> The Board of Commissioners voted to deny the preliminary <br /> plan. The reason for the denial was concern about the <br /> safety of the existing bridge crossing the Eno River. <br /> Concerns were also expressed about the ability of a home <br /> owners association to maintain the bridge. <br /> The applicant has provided materials that address the Board <br /> of Commissioners concern. They propose to construct all <br /> roads in the subdivision, rebuild the bridge over the Eno <br /> River and extend Lake Orange Road, all to N.C. Department of <br /> Transportation standards. Doing so would adequately address <br /> the Board of Commissioners concern. <br /> The Planning Board recommends approval with the following <br /> conditions: <br /> (1) Provide a notation on the Final Plat indicating re- <br /> stricted development potential if lots 17 and 18 prove <br /> unsuitable for septic systems. <br /> (2) Meet with the Recreation and Parks Director regarding a <br /> voluntary donation of an easement in the 100-year <br /> floodplain area adjacent to the Eno River. <br /> (3) Construction of all roads in the subdivision and up- <br /> grading Lake Orange Road from the end of State main- <br /> tenance to the subdivision, including the Eno River <br /> bridge, to NCDOT standards as proposed by the <br /> applicant. <br /> RECOMMENDATION: The Manager recommends approval of the preliminary plan as <br /> recommended by the Planning Board with the following added <br /> stipulations: <br /> 1. That safeguard measures be installed by Orange County <br /> to prevent public access to the Lake Orange dam <br /> structure and spillway; and <br /> 2 . That the safeguard measures be installed prior to the <br /> issuance of any certificates of occupancy for dwellings <br /> in the development. <br />
