O8t 2 <br /> area; and <br /> e) the subdivision roads, even if constructed to <br /> State Standards, would not be accepted by the <br /> State for maintenance due to density or some <br /> other State requirements that the subdivision <br /> cannot meet. <br /> EVALUATION <br /> In applying these conditions to the Subdivision of Lot <br /> 101 of the Margaret Yost Property, the Planning Department <br /> notes the following: <br /> 1 . The proposed subdivision is located adjacent to the <br /> right of way of Interstate 85 . Because of the <br /> location and design, the function of Justa Road is <br /> to serve only the four lots being proposed . <br /> 2. a) The subdivision consists of less than ten ( 10 ) <br /> lots . <br /> b) The subdivision does not preserve a natural <br /> area. <br /> c) The subdivision does not include or abut any <br /> part of a thoroughfare or street shown on the <br /> Orange County thoroughfare plan or on the <br /> • thoroughfare plan of an Orange County munici- <br /> pality . It does not lie within a designated <br /> transition area determined by the County. <br /> d) The subdivision extends an existing subdivi - <br /> sion where the road is private or unpaved. <br /> e) The proposed subdivision represents the <br /> minimum requirement for state acceptance for <br /> maintenance. However, all lots must be <br /> developed before the state will consider <br /> taking over maintenance of Justa Road. <br /> RECOMMENDATION <br /> The evaluation of the proposed road in this subdivision <br /> indicates that a private road is appropriate. <br /> Private roads are appropriate for small subdivisions <br /> with large lots such as this one. The road proposed will <br /> serve this property and will not be part of an existing or <br /> proposed street system. <br /> The subdivision satisfies three of the five conditions <br />
