51 <br /> FTA FISCAL YEAR 2016 CERTIFICATIONS AND ASSURANCES <br /> g. (1) It has or will have the amount of funds required for the non-federal share by <br /> the SIB Program, but not less than twenty-five (25)percent of each <br /> capitalization grant, <br /> (2) It will provide the non-federal share from sources approved by FTA, and <br /> (3) It will provide the non-federal share when needed. <br /> h. It will comply with: <br /> (1) The metropolitan transportation planning requirements of 49 U.S.C. § 5303, <br /> and <br /> (2) The statewide and nonmetropolitan planning requirements of 49 U.S.C. <br /> § 5304. <br /> i. It has a locally developed process to solicit and consider public comment before: <br /> (1) Raising a fare, or <br /> (2) Implementing a major reduction of public transportation. <br /> j. It will comply with the final federal regulations that, when issued, will implement <br /> the safety plan requirements of 49 U.S.C. § 5329(d). <br /> 6. As required by 49 U.S.C. chapter 53, it certifies that it will not seek reimbursement <br /> for interest or any other financing costs incurred in connection with its Award unless: <br /> a. It is eligible to receive federal assistance for those expenses, and <br /> b. Its records demonstrate that it has used reasonable diligence in seeking the most <br /> favorable financing terms underlying those costs, as FTA may require. <br /> 7. It agrees that it will adopt a transit asset management plan that complies with <br /> regulations implementing 49 U.S.C. § 5326(d). <br /> GROUP CATEGORY 22. PAUL S. SARBANES TRANSIT IN PARKS <br /> PROGRAM <br /> Before FTA may provide federal assistance for an Award financed under the Paul S. <br /> Sarbanes Transit in Parks Program authorized under former 49 U.S.C. §5320, in effect <br /> in FY 2012 or a previous fiscal year, except as superseded by FAST Act requirements <br /> that apply you must select the Certifications in Category 22 in addition to other <br /> Certifications and Assurances you must select on your Applicant's behalf except as FTA <br /> determines otherwise in writing. <br /> Any provision of the Certifications and Assurances in Category 22 that does not apply <br /> will not be enforced. <br /> 1. Except as superseded by the FAST Act cross-cutting requirements that apply, the <br /> following Certifications and Assurances for the Paul S. Sarbanes Transit in Parks <br /> Program(Parks Program) are required by former 49 U.S.C. § 5320, in effect in <br /> FY 2012 or a previous fiscal year.
