42 <br /> FTA FISCAL YEAR 2016 CERTIFICATIONS AND ASSURANCES <br /> e. With respect to the non-federal share: <br /> (1) It has or will have and, as necessary, will require each Subrecipient to have <br /> the amount of funds required for the non-federal share, as required by <br /> 49 U.S.C. § 5310, <br /> (2) It will provide and, as necessary, will require each Subrecipient to provide <br /> the non-federal share from sources approved by FTA, and <br /> (3) It will provide and, as necessary, will require each Subrecipient to provide <br /> the non-federal share when needed. <br /> f. It has complied or will comply and will require each Subrecipient to comply with: <br /> (1) The metropolitan transportation planning requirements of 49 U.S.C. § 5303, <br /> and <br /> (2) The statewide and nonmetropolitan transportation planning requirements of <br /> 49 U.S.C. § 5304. <br /> g. To the extent applicable, it will comply and require its Subrecipients to comply <br /> with the final federal regulations that, when issued, will implement the safety plan <br /> requirements of 49 U.S.C. § 5329(d). <br /> CATEGORY 16. RURAL AREAS AND APPALACHIAN DEVELOPMENT <br /> PROGRAMS. <br /> Before FTA may provide federal assistance for an Award financed under the Formula <br /> Grants for Rural Areas Program authorized under 49 U.S.C. §5311(b), as amended by <br /> FAST Act, and the Appalachian Development Public Transportation Assistance Program <br /> authorized under 49 U.S.C. §5311(c)(2), as amended by FAST,you must select the <br /> Certifications in Category 16 in addition to other Certifications and Assurances you must <br /> select on your Applicant's behalf except as FTA determines otherwise in writing. <br /> Any provision of the Certifications and Assurances in Category 16 that does not apply <br /> will not be enforced. <br /> 16.A. Formula Grants for Rural Areas Program. <br /> If your Applicant seeks federal assistance from FTA for an Award financed under the <br /> Formula Grants for Rural Areas Program authorized under 49 U.S.0 §5311, as <br /> amended by FAST Act, the Certifications in Category 16.A apply to your Applicant, <br /> except as FTA determines otherwise in writing. <br /> The following Certifications apply to each state or state organization serving as your <br /> Applicant for federal assistance appropriated or made available for the Rural Areas <br /> Formula Program financed under 49 U.S.C. § 5311(b), as amended by FAST Act.
