38 <br /> FTA FISCAL YEAR 2016 CERTIFICATIONS AND ASSURANCES <br /> c. It will provide the non-federal share when needed. <br /> 8. As required by 49 U.S.C. § 5307(c)(1)(H), it will comply with: <br /> a. The metropolitan transportation planning requirements of 49 U.S.C. § 5303, and <br /> b. The statewide and nonmetropolitan transportation planning requirements of <br /> 49 U.S.C. § 5304. <br /> 9. As required by 49 U.S.C. § 5307(c)(1)(I), it has a locally developed process to solicit <br /> and consider public comment before: <br /> a. Raising a fare, or <br /> b. Implementing a major reduction of public transportation. <br /> 10. Each fiscal year: <br /> a. It will assure that at least one (1)percent of the amount of federal assistance under <br /> 49 U.S.C. § 5307 apportioned to its urbanized area must be expended for Public <br /> Transportation Security activities as described in 49 U.S.C. § 5307(c)(1)(J)(i) <br /> including: <br /> (1) Increased lighting in or adjacent to a public transportation system(including <br /> bus stops, subway stations,parking lots, and garages), <br /> (2) Increased camera surveillance of an area in or adjacent to that system, <br /> (3) Emergency telephone line or lines to contact law enforcement or security <br /> personnel in an area in or adjacent to that system, and <br /> (4) Any other activity intended to increase the security and safety of an existing <br /> or planned public transportation system, or <br /> b. The Designated Recipients in its urbanized area certify that such expenditures for <br /> Public Transportation Security activities are not necessary. <br /> 11. If it serves an urbanized area with a population of at least 200,000 individuals, as <br /> determined by the Bureau of the Census: <br /> a. It will provide a report by the end of the fourth quarter of the preceding federal <br /> fiscal year that lists projects carried out in the preceding fiscal year under this <br /> section for associated transit improvements as defined in 49 U.S.C. § 5302, and <br /> b. The report of its Associated Transit Improvements or related activities is or will <br /> be incorporated by reference and made part of its Certifications and Assurances. <br /> 12. It will comply with the final federal regulations that, when issued, will implement the <br /> safety requirements of 49 U.S.C. § 5329(d). <br /> 14.B. Passenger Ferry Grant Program. <br /> If your Applicant seeks federal assistance from FTA for an Award financed under the <br /> Passenger Ferry Grant Program authorized under 49 U.S.C. §5307(h), the <br /> Certifications in Category 14.B apply to your Applicant, except as FTA determines <br /> otherwise in writing. <br /> 33 <br />
