32 <br /> FTA FISCAL YEAR 2016 CERTIFICATIONS AND ASSURANCES <br /> On behalf of your Applicant, you certify that: <br /> 1. It has or will have the legal, financial, and technical capacity to carry out its Award, <br /> including the safety and security aspects of that Award, <br /> 2. It has or will have satisfactory continuing control over the use of its equipment and <br /> facilities acquired or improved under its Award, <br /> 3. It will maintain its equipment and facilities acquired or improved under its Award, in <br /> accordance with the recipient's transit asset management plan, and <br /> 4. It will comply with: <br /> a. The metropolitan transportation planning requirements of 49 U.S.C. § 5303, and <br /> b. The statewide and nonmetropolitan transportation planning requirements of <br /> 49 U.S.C. § 5304. <br /> CATEGORY 13. GRANTS FOR BUSES AND BUS FACILITIES AND LOW OR <br /> NO EMISSION VEHICLE DEPLOYMENT GRANT PROGRAMS <br /> Before FTA may provide federal assistance for an Award under the Buses and Bus <br /> Facilities Program authorized under 49 U.S.C. §5339, as amended by the FAST Act, <br /> which among other things authorizes grants for Low or No Emission buses,you must <br /> select the Certifications in Category 13 in addition to other Certifications and <br /> Assurances you must select on your Applicant's behalf except as FTA determines <br /> otherwise in writing. <br /> Any provision of the Certifications in Category 13 that does not apply will not be <br /> enforced. <br /> 13.A. Grants for Buses and Bus Facilities Program The following Certifications for <br /> the Grants for Buses and Bus Facilities Program are required by 49 U.S.C. § 5339, as <br /> amended by the FAST Act, which provides that the requirements of 49 U.S.C. § 5307 <br /> shall apply to recipients of grants made in urbanized areas and the requirements of <br /> 49 U.S.C. § 5311 shall apply to recipients of grants made in rural areas under this <br /> 49 U.S.C. §§ 5339(a) and(b). Therefore: <br /> 1. If your Applicant is in an urbanized area, except as FTA determines otherwise in <br /> writing, on behalf of your Applicant, you certify that: <br /> a. It has or will have the legal, financial, and technical capacity to carry out its <br /> Award, including the safety and security aspects of that Award. <br /> b. It has or will have satisfactory continuing control over the use of its equipment <br /> and facilities acquired or improved under its Award. <br /> c. It will maintain its equipment and facilities acquired or improved under its <br /> Award, in accordance with the recipient's transit asset management plan, <br /> 27 <br />
