28 <br /> FTA FISCAL YEAR 2016 CERTIFICATIONS AND ASSURANCES <br /> significantly contribute to the provision of one or more Intelligent Transportation <br /> System(ITS)user services as defined in the "National ITS Architecture." <br /> 2. Assure that, as provided in 23 U.S.C. § 517(d), any Award that includes an ITS or <br /> related activity financed with appropriations made available from the Highway Trust <br /> Fund, including amounts made available to deploy ITS facilities or equipment, will <br /> conform to the appropriate regional ITS architecture, applicable standards, and <br /> protocols developed under 23 U.S.C. § 517(a) or (c), unless it obtains a waiver as <br /> provided in 23 U.S.C. § 517(d)(2). <br /> CATEGORY 08. INTEREST AND FINANCING COSTS AND ACQUISITION OF <br /> CAPITAL ASSETS BY LEASE. <br /> Before FTA may award federal assistance appropriated or made available under <br /> 49 U.S.C. chapter 53 to support the interest,financing, or leasing costs of any Award <br /> financed under the Urbanized Area Formula Grants Program, Fixed Guideway Capital <br /> Investment Grants Program, any program to which the requirements of 49 U.S.C. §5307 <br /> apply, or any other program as FTA may spec, you must select the Certifications in <br /> Category 08 in addition to other Certifications and Assurances you must select on your <br /> Applicant's behalf except as FTA may determine otherwise in writing. <br /> Any provision of the Certifications and Assurances in Category 08 that does not apply <br /> will not be enforced. <br /> 08.A. Interest and Financing Costs. <br /> If your Applicant intends to use federal assistance to support the interest or any other <br /> financing costs for an Award financed under the Urbanized Area Formula Grants <br /> Program, the Fixed Guideway Capital Investment Grants Program, the New Starts, Small <br /> Starts, and Core Capacity Programs, any program that must comply with the <br /> requirements of 49 U.S.C. §5307, or any other program as FTA may specify, the Interest <br /> and Financing Costs Certifications in Category 08.A apply to your Applicant, except as <br /> FTA determines otherwise in writing. <br /> On behalf of your Applicant, you certify that: <br /> 1. It will not seek reimbursement for interest or any other financing costs unless: <br /> a. It is eligible to receive federal assistance for those costs, and <br /> b. Its records demonstrate that it has shown reasonable diligence in seeking the most <br /> favorable financing terms, as FTA may require. <br /> 2. It will comply with the same favorable financing cost provisions for Awards financed <br /> under: <br /> a. The Urbanized Area Formula Grants Program, <br /> b. A Full Funding Grant Agreement, <br /> 23 <br />
