13 <br /> FTA FISCAL YEAR 2016 CERTIFICATIONS AND ASSURANCES <br /> g. It will require that each covered lower tier contractor and subcontractor: <br /> (1) Comply and facilitate compliance with the federal requirements of 2 CFR <br /> parts 180 and 1200, and <br /> (2) Assure that each lower tier participant in its Award is not presently declared <br /> by any federal department or agency to be: <br /> (a) Debarred from participation in any federally assisted Award, <br /> (b) Suspended from participation in any federally assisted Award, <br /> (c) Proposed for debarment from participation in any federally assisted <br /> Award, <br /> (d) Declared ineligible to participate in any federally assisted Award, <br /> (e) Voluntarily excluded from participation in any federally assisted Award, <br /> or <br /> (f) Disqualified from participation in any federally assisted Award. <br /> 5. It will provide a written explanation if it or any of its principals, including any of its <br /> first tier Subrecipients or its Third Party Participants at a lower tier, is unable to <br /> certify compliance with the preceding statements in this Category 01.E Certification. <br /> 01.F. U.S. OMB Assurances in SF-424B and SF-424D. <br /> The assurances in this Category O1.F are consistent with the U.S. OMB assurances <br /> required in the U.S. OMB SF-424B and SF-424D, and updated as necessary to reflect <br /> changes in federal laws, regulations, and requirements. <br /> 1. Administrative Activities. On behalf of your Applicant, you assure that: <br /> a. For any application it submits for federal assistance, it has adequate resources to <br /> plan, manage, and complete properly the tasks to implement its Award, including: <br /> (1) The legal authority to apply for federal assistance, <br /> (2) The institutional capability, <br /> (3) The managerial capability, and <br /> (4) The financial capability(including funds sufficient to pay the non-federal <br /> share of the cost of incurred under its Award). <br /> b. As required, it will give access and the right to examine materials related to its <br /> Award to the following entities or individuals, including, but not limited to: <br /> (1) FTA, <br /> (2) The Comptroller General of the United States, and <br /> (3) The State, through an appropriate authorized representative. <br /> c. It will establish a proper accounting system in accordance with generally accepted <br /> accounting standards or FTA guidance. <br /> d. It will establish safeguards to prohibit employees from using their positions for a <br /> purpose that results in: <br /> (1) A personal or organizational conflict of interest or personal gain, or <br /> 8 <br />
