Reyes, Executive Director for <br />Operations at the Nuclear Regulatory Commission (NRC), and filed on behalf of numerous <br />petitioners, has been referred.to me pursuant to Title 10 of the Code of Federal Regulations <br />(10 CFR), Section 2.206. You request thatthe NRC immediately issue an Order suspending <br />the Shearon Harris Nuclear Power Plant (SHNPP) operating license until SHNPP is in <br />compliance with fire safety regulations. As the basis for your request, you discuss several fire <br />safety violations at SHNPP which could affect the safe operation of the plant and safe shutdown <br />of the plant in emergency situations. I would like to express my appreciation for your effort in <br />bringing these matters to the attention of the NRC. <br />The Petition Review Board (PRB) met on October 10, 2006, to discuss your request for <br />immmediate action to revoke SHNPP's operating licenser The PRB denied your request for <br />immediate action based on the staff's determination that there was no immediate threat to <br />public health,and safety. You were notified of this by phone on October 17, 2006. <br />In a public meeting at NRC Headquarters on November 13, 2006, you met with the PRB to <br />present additional relevant information concerning your petition. The supplemental documents <br />dated October 23 and 30, 2006, and submitted on October 23 and November 13, 2006, have <br />been entered into the NRC's Agencywide Documents Access and Management System <br />(ADAMS) under accession numbers ML062980107 and ML063200168, respectively. The <br />results of that discussion and the supplemental documents have been considered in the PRB's <br />determination regarding your petition and in establishing the schedule for the review of your <br />petition. <br />After considering the petition request, and information provided at the public meeting, the PRB <br />has determined that your request does meet the criteria for acceptance as a 10 CFR 2.206 <br />petition. <br />DEC 0 D 2006 <br />Lr -- <br />�. <br />
