UNITED STATES <br />NUCLEAR REGULATORY COMMISSION <br />WASHINGTON, D.C. 20555-0001 <br />December 19, 2006 <br />LICENSEE: Carolina Power & Light <br />FACILITY: Shearon Harris Nuclear Power Plant, Unit 1 <br />2006 <br />SUBJECT: SUMMARY OF NOVEMBER 13,2,006, PUBLIC MEETING REGARDING THE <br />PETITION FOR ENFORCEMENT ACTION PURSUANT TO 10 CFR 2.206 FOR <br />SHEARON HARRIS NUCLEAR POWER PLANT RECURRING FIRE <br />PROTECTION ISSUES <br />On November 13, 2006, a public meeting was held at the Nuclear Regulatory Commission <br />(NRC) Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, Maryland. The <br />purpose of the meeting was to provide representatives from North Carolina Waste Awareness <br />and Reduction Network (NC WARN), Nuclear Information and Resource Services (NIRS), the <br />Union of Concerned Scientists (UCS) and their appointed attorney an opportunity to present <br />additional relevant information concerning their petition submitted under Title 10 of the Code of <br />Federal Regulations (10 CFR) Part 2.206.. This meeting also provided the NRC staff with an <br />opportunity to ask clarifying questions concerning the•submitted petition. A list of attendees is <br />provided as an Enclosure. <br />By letter dated September 20, 2006 (Ageneywide Documents Access and Management System <br />(ADAMS) accession number ML062640550), John D. Runkle, Attorney for the petitioners, <br />submitted a 10 CFR 2.206 Petition requesting that the NRC issue an order requiring the <br />immediate suspension of the operating license for the Shearon Harris Nuclear Power Plant <br />(SHNPP) until alleged fire safety violations are brought into compliance. The petitioners claim <br />that SHNPP has been in violation of NRC fire safety regulations for over 14 years. The <br />concerns focus on the lack of protection against fires and the subsequent ability to safely <br />shutdown the plant in the event of a fire. The supporting documentation includes a report by <br />NC WARN, NIRS, and UCS, "Delaying with Fire: The Shearon Harris Nuclear Plant and <br />14 Years of Fire Safety Violations." Further, the groups demand that the NRC refuse to <br />consider an early relicensing request by SHNPP until the plant is in compliance with fire-safety <br />regulations. A public meeting was attempted on October 23, 2006, but had to be cancelled due <br />to the loss of recording capability in the Operations Center. Supplemental documentation was <br />presented by the petitioners at this meeting and is publicly available (ADAMS Accession <br />Number ML062980107). <br />SUMMARY <br />The petitioners presented information in support of their request to suspend the SHNPP <br />Operating License or to impose maximum fines for each fire violation until the plant comes into <br />compliance. They submitted Supplemental documentation (ADAMS accession i number <br />ML063200168). Their concerns focused on the licensee's longstanding fire safety violations, <br />the licensee's long term use of compensatory measures, and the NBC's use of enforcement <br />discretion to prolong SHNPP's noncompliances. The petitioners also made repeated requests <br />for open and public proceedings with NRC, Progress Energy, and external stakeholders in the <br />vicinity of SHNPP. <br />
