4 <br /> Draft New Ordinance <br /> Attachment 1 <br /> 144ft12171131911t22Lancre Count <br /> Personnel OrdinanceW-fr <br /> Section 2.0 Sexual Harassment Polio <br /> 2.0 SEXUAL HARASSMENT <br /> 2.1 General <br /> Orange County prohibits sexual harassment of employees <br /> or applicants for employment and guarantees employees <br /> the right to work in an environment free from sexual <br /> harassment. Sexual harassment constitutes unlawful <br /> discrimination on the basis of sex. <br /> 2.2 Definition <br /> Unwelcome sexual advances, requests for sexual favors <br /> and other verbal or physical conduct of a sexual nature <br /> constitute sexual harassment when: <br /> -Submission to such conduct is made either explicitly <br /> or implicitly a term or condition of employment; or <br /> -Submission to or rejection of such conduct by an <br /> individual is used as the basis for employment <br /> decisions affecting such an individual; or <br /> -Such conduct has the purpose or effect of <br /> unreasonably interfering with an individual's work <br /> performance or creating an intimidating, hostile or <br /> offensive working environment. <br /> Examples of sexual harassment may include, but are <br /> not limited to, intentional physical contact (touching, <br /> patting, pinching) , verbal abuse (offensive jokes, <br /> requests for sexual favors, demeaning statements) and <br /> taking employment action on the basis of sexual <br /> consideration. <br /> Sexual harassment does not include conduct welcomed by <br /> the recipient, or social interactions and relationships <br /> entered into freely by County applicants or employees. <br /> 2.3 Complaint <br /> Any employee or applicant who feels he or she is being <br /> subjected to sexual harassment may raise a complaint <br /> directly: <br />
