Each local <br /> government shall receive a certificate and be named certificate holder. <br /> Renewal certificates shall be sent to each local government 30 days <br /> prior to any expiration date. There shall also be a 30 day notification <br /> to the local governments in the event of cancellation•or modification <br /> of any stipulated insurance coverage. Wording on the Certificate of <br /> Insurance which states that no liability shall be imposed upon the <br /> company for failure to provide such notice is not acceptable. Original <br /> policies or certified copies of policies may be required by the local <br /> governments at any time. <br /> 3. It shall be the responsibility of the contractor to insure that all <br /> subcontractors comply with the same insurance requirements that he <br /> is required to meet. <br /> 4. Hold Harmless: The Contractor agrees to indemnify and hold <br /> harmless the local governments from all loss, liability, claims or <br /> expense (including reasonable attorneys' fees) arising from bodily <br /> injury, including death or property damage to any person or persons <br /> caused in whole or in part by the negligence or willful misconduct of <br /> the contractor except to the extent same are caused by the negligence <br /> or misconduct of the local governments. <br /> D. . Alternate Coverage <br /> - I. If the Contractor does not meet the insurance requirements of these <br /> specifications, alternate insurance coverage satisfactory to the local <br /> governments may be considered. <br /> V. BASIS OF AWARD <br /> Award of contract by TRSWPC will he to the most responsible and responsive <br /> bidder. Proposers should make written proposals demonstrating their qualifications <br /> and understanding of the request for household hazardous waste disposal services, <br /> as presented in this RFP. Furthermore, firms must be advised that a mere repetition <br /> of tasks taken from the Tasks to be Performed sections shall he considered <br /> nonresponsive to the RFP. The Proposer must demonstrate an understanding of the <br /> significance of each individual task. TRSWPC reserves the right to reject any or all <br /> bids and waive any and all formalities and the right to disregard all nonconforming <br /> or conditional bids or counter-proposals and to award the contract to other than the <br /> lowest bidder at the discretion and in the best interest of all participating local <br /> governments. <br /> A preliminary evaluation of all proposals will he conducted based on the information <br /> provided in the proposal, the ability of the Proposer to perform, past performance, <br /> 9 <br />
