Triangle Region Solid Waste Planners Committee Household Hazardous Waste <br /> October 28, 1993 <br /> OPTIONAL HHW AGREEMENT PARAGRAPHS <br /> Laidlaw's standard household hazardous waste agreement addresses issues common to most <br /> programs, however some program sponsors have special needs. Laidlaw has prepared the <br /> following sections to address these needs: <br /> 1. Not to Exceed Clause <br /> When the program sponsor has a limited budget, they may elect to have LES stop accepting <br /> waste when the limit is approached. Please note that this does not mean that LES is performing <br /> a fixed price contract! The unit prices in the proposal still apply, but our on site personnel <br /> should do a rough estimate of total program cost several times during the project, including set- <br /> up charge, packed drums, approximate waste yet to be packed, and any charges for materials, <br /> personnel, overtime, etc. The sponsor must be informed well before costs go over the "not to <br /> exceed" price. The following language may be added to the Compensation and Payment <br /> paragraph of the contract: <br /> The Sponsor has been allocated $ for this program. Consequently, LES will <br /> be given a "not to exceed" price. Periodically during the performance of waste handling and <br /> packaging services, the LES Project Manager will inform the Sponsor of his or her best estimate <br /> of the expenses incurred to that time. In the event that the estimate approximates the "not to <br /> exceed" price, LES will prepare to curtail its operations unless the authorized representative of <br /> the Sponsor directs LES to perform additional work. In this case the Sponsor will compensate <br /> LES in accordance with the unit prices already supplied to the Sponsor. <br /> r _ <br /> 2. Containers and Supplies <br /> Occasionally, a program sponsor may have a source for shipping containers and packaging <br /> supplies, such as from donations by business or industry within the community. If the sponsor <br /> wishes to have Laidlaw use these supplies, the following language should be inserted into the <br /> Agreement: <br /> The Sponsor may, if it elects, supply empty containers and other packaging supplies needed for <br /> this program, provided however that any such containers and supplies be of the DOT <br /> specification, type, size and quality normally used by LES during programs of this type, in <br /> accordance with legal and prudent hazardous materials transportation requirements and the waste <br /> Laidlaw Environmental Services <br />
