Southard and Faye M. <br /> Southard for a reduction in right-of-way width from 50 <br /> feet to 30 feet. <br /> BACKGROUND: The Southards wish to create a 1. 382 acre lot out of a <br /> 13 . 08 acre tract. The property is located north of U. S. <br /> Highway 70. An existing private road approximately 490 <br /> feet in length (200 feet with a 30 foot right-of-way and <br /> 290 with a 50 foot right-of-way) will provide access to <br /> the property. The required road classification is Class C <br /> because the access will serve a total of three lots. <br /> A partial width right-of-way was approved (for this <br /> private road) by the Board of Commissioners on November 1, <br /> 1988 . The private road provided access to Lot 2 (recorded <br /> at PB 51 Pg 86) and the remaining acreage (Lot 1 and the <br /> newly proposed Lot 3) . The circumstances which warranted <br /> a partial width right-of-way for the initial proposal <br /> continue to exist. The Doby lot (referenced as Will Book <br /> 87-E-200) is nonconforming in size for the zoning <br /> district and the existing dwelling on the Doby lot does <br /> not allow for the additional 20 feet required for the <br /> right-of-way without interfering with the required <br /> minimum building setback. In addition, the property owner <br /> (James A. Wynn) west of Glisson Drive is unwilling to <br /> grant or sell the needed area for the full required right- <br /> of-way width. <br />
