Memorandum of Lease <br />INFORMATION CONTACT: <br />Geoff Gledhill, County.Attorney, 732-2196 <br />Laura Blackmon, County Manager, 245-2300 <br />Ken Chavious, Finance Director, 245-2453 <br />Donna Coffey, Budget Director, 245-2151 <br />PURPOSE: To approve an inter-local agreement with the Chapel Hill-Carrboro City Schools <br />district that provides for a forty year land lease and designation of the School Board as agent of <br />the Orange County Board of County Commissioners in constructing and equipping Elementary <br />School # 10 within mutually approved finances. <br />BACKGROUND: North Carolina statutes allow counties and. school boards to enter into inter- <br />local agreements, lease agreements, and agency agreements. These actions, as contained in <br />the documents attached, will enable the Board of County Commissioners and School Board to <br />facilitate the building and equipment of Elementary School # 10 within existing financial <br />resources. <br />The County owns the property for Elementary School #10 fee simple, and is allowed to reclaim <br />sales and use taxes. paid by the various contractors and vendors associated with the School <br />construction project. The County will appropriate the sales tax refunds to the school <br />construction budget. <br />Significant elements of the proposed Inter-local Agreement are shown below: <br />• County will lease Elementary School #10 property to the School Board <br />• Lease will terminate in 40 years, or upon land transfer by the County to the School Board <br />• Title to property will remain in the County's name until and unless conveyed <br />• School Board must make reports to the BOCC on any subleasing or assignment <br />arrangements by Sept 15 for the previously completed fiscal year <br />
