2) Add a riser-type pipe outlet as the primary outlet; 7 <br /> 3) Construct an emergency spillway to safely carry the 100-year flow; <br /> 4) Repair burrow holes and other damage from beaver activity and take <br /> steps to control further damage; <br /> 5) Remove small trees (approximately 4" diameter) and undergrowth <br /> from the top and backslope of the dam. Dead or unhealthy trees <br /> shall also be removed; and <br /> 6) Fill low areas to provide a consistent dam elevation; <br /> b. The Wyngate Lakes Homeowners Association shall be responsible for <br /> continued inspection and maintenance of the dam. Provisions for <br /> assessments, inspection, and maintenance shall be included in the <br /> restrictive covenants recorded with the Final Plat. <br /> E. Parkland <br /> 1. Cash in the amount of $1,448 ($3,900/acre x 13/35 acre) shall be paid to <br /> Orange County as payment in lieu of parkland dedication. <br /> 2. The entirety of the open space to be shown on the Final Plat shall be <br /> irrevocably dedicated to the homeowners association for recreation/open space <br /> use by residents of the subdivision. <br /> 3. The 20-foot private pedestrian access easement shall be provided between <br /> Rhine Road and the common area. <br /> F. Miscellaneous <br /> 1. The Final Plat shall contain'a title block and vicinity map in accordance with <br /> Section V-D-2 and V-D-3 of the Orange County Subdivision Regulations. <br /> 2. The following natural and man-made site features shall be shown on the plat: <br /> (Include streams, rivers, ponds, lakes, swamps, marshes, sites in "Inventory", <br /> houses, barns, sheds, railroads, overhead utility lines, cemeteries) <br /> a. existing lake and beaver pond; <br /> b. cemetery and easement on Lot 2; and <br /> c. drainage way and 50-foot easement across Lots 1 and 12. <br /> 3. The following easements shall be shown on the plat: <br /> a. cemetery easement with 15-foot private access easement on Lot 2; <br /> b. 50-foot drainage easement across Lots 1 and 12; and <br /> c. septic easement and 20-foot line and access easement on Lots 5.21..112 <br /> and 5.21..74. <br />
