4 <br /> to execution of a construction contract or receipt of any <br /> grant funds. Ownership of the STEP systems was to be <br /> assumed by OWASA. OWASA is now reconsidering its decision <br /> to own the STEP systems and County staff have responded by <br /> recommending that additional safeguards be included in the <br /> agreements. In the revised agreements, language <br /> specifically listing the STEP systems as a portion of the <br /> system to fall under County or OWASA ownership or legal <br /> responsibility has been excised. However, the revisions do <br /> specifically state that the home owners will be required to <br /> make an initial deposit or to utilize grant reimbursements <br /> to provide sufficient funds to the County and/or OWASA for <br /> the repair or replacement of the STEPs. In essence, the <br /> concept that the home owners deposit with the County all <br /> funds necessary for system construction remains intact <br /> within the revised agreements. The revised agreements do, <br /> however, provide a degree of flexibility with regard to <br /> financing the repair or replacement of the individual STEP <br /> systems by allowing for use of the proceeds from the grant <br /> funds. <br /> RECOMMENDATION: The administration and staff, while recognizing that <br /> the issues and solutions identified above and in the <br /> attached agreements could be seen in a different <br /> perspective by the Piney Mountain home owners or by <br /> OWASA, nonetheless recommends that the Board: <br /> a) approve the agreements as submitted; b) authorize <br /> the Chair to sign the agreements when finalized; <br /> c) authorize the Chair, County Manager and County <br /> Attorney to devise modifications to the agreements as <br /> necessary to secure accord among the other parties to <br /> the agreements, with the proviso that the intent of the <br /> agreements will not be modified without the approval of <br /> the BOCC; and d) withdraw from the grant funding and <br /> system ownership process if these conditions prove to <br /> be too onerous to either the home owners or OWASA. <br />
