The COUNTY further agrees to refund to the Association <br /> such sums as it has received that exceed the cost of the certified <br /> STEP system repairs or replacements . <br /> The parties specifically agree that OWASA' s inspection of, <br /> oversight and approval of the work to repair or reconstruct, and <br /> acceptance of wastewater from or to, the STEP systems and collector <br /> system shall not constitute any warranty of the condition of either <br /> said component of the wastewater system, and that the Association <br /> and its members shall look only to the engineers and contractors <br /> who designed and constructed said improvements and repairs for such <br /> warranty and assurance, it being the specific assurance that <br /> neither the Association nor any member thereof shall bring any <br /> claim or action against OWASA or the COUNTY arising out of the <br /> repair or reconstruction of the system, or any action or inaction <br /> of OWASA or the COUNTY related thereto . <br /> 5 . The COUNTY shall be the owner of the Subdivision <br /> wastewater system. The ASSOCIATION agrees to obtain and provide to <br /> the County on demand such indicia of ownership of the Subdivision <br /> wastewater system as determined reasonably necessary by the COUNTY <br /> in the form of deeds , release deeds, subordination agreements, <br /> encroachment agreements , dedications, easements and bills of sale . <br /> 6 . The COUNTY agrees to convey to OWASA and OWASA agrees to <br /> accept from the COUNTY all of the COUNTY's right, title and <br /> interest to the Subdivision wastewater system within a reasonable <br /> amount of time, but in no event more than six ( 6 ) months, after the <br /> happening of the first of the following events : <br /> 6 <br />
