Ntrecer_: _ <br /> PURPOSE; To consider an amendment to the existing contract <br /> NEED: An amendment received by the State must also be approved by <br /> each contracting entity. The amendment pertains to record <br /> retention responsibility defined as follows: <br /> 3.7.2 Retain all financial records, supporting documents, <br /> statistical records and all other records pertinent to a <br /> contract until final audit, resolution of audit questions <br /> costs and release of the Contractor from responsibility <br /> under this contract by the Prime Sponsor. In the event <br /> the Contractor goes out of business or ceases to be an . <br /> organization prior to the expiration of records retention <br /> responsibility, the Contractor will deliver all records <br /> required to be retained hereunder to the Prime Sponsor. <br /> Negligent or intentional failure to retain and/or to <br /> surrender any or all of the records as required hereunder <br /> shall result in the liability of the Contractor for such <br /> disallowed costs (a) that the Prime Sponsor is required to <br /> repay to the United States Department of Labor and (b) <br /> where all or part of records regarding which disallowed <br /> costs are unavailable to the Prime Sponsor at the time of <br /> disallowance and/or at the time of required repayment, without <br /> regard to whether the unavailable records would have sup- <br /> ported or rebutted the disallowance. The Contractor shall <br /> satisfy the requirement stated below appropriate to the <br /> organization of the Contractor: <br /> (i) If the Contractor is a unit or agency of govern- <br /> ment or a public educational or training facility, <br /> the Contractor shall make satisfactory assurances <br /> to the Prime Sponsor of its ability to fulfill its <br /> responsibilities and obligations under this sub- <br /> section. <br /> IMPACT: Since present practice is in accorA. with that is s+ipulat <br /> there will be no impact in administrative cost or procedure_ <br /> RECOMMENDATION: <br /> Approve the amendment and authorize the Chairman to sign. <br />
