Such <br /> action shall include, but not be limited to, the folloing; employment, <br /> '-111grading, demotion, or transfer; recruitment or recruitment advertising; <br /> layoff or termination; rates of pay or other forms of compensation; and <br /> selection for training, including apprenticeship, The APPRAISER agrees <br /> to post in conspicuous places, available to employees and applicants <br /> for employment, notices to be provided by the COUNTY, as the COUNTY may <br /> deem appropriate, setting forth the provisions of this nondiscrimination <br /> clause. <br /> (2) The APPRAISER will , in all solicitations or advertisements for employees <br /> placed by or on behalf of the APPRAISER, state that all qualified appli- <br /> cants will receive consideration for employment without regard to race, <br /> color, religion, sex, or national origin. <br /> (g) ectior ----mativeAction, During the performance of this agreement <br /> the APPRAISER agrees as follows <br /> (1) The work to be performed under this agreement is on a proiect assisted <br /> under a program providing direct Federal financial assistance from the <br /> Department of Housing and Urban Development and is subject to the require <br /> mentS of Section 3 of the Housing and Urban Development Act of 1968, <br /> as amended. Section 3 requires that to the greatest extent feasible <br /> opportunities for training and employment be given lower income residents <br /> of the project area and contracts for work in connection with the project <br /> be awarded to business concerns which are located in, or owned in <br /> substantial part, by persons residing in the area of the project. <br /> (2) The parties to this agreement will comply with the provisions of said <br /> Section 3 and the regulations issued pursuant thereto by the Secretary <br /> of Housing and Urban Development and all applicable rules and orders <br /> of the Department issued thereunder prior to the execution of this <br /> agreement. <br /> (h) Discrimination Because of C-rtain Labor Matters. The APPRAISER agrees <br /> no person emp oye. on the work covered by this agreement shall be discharged or <br /> in any way discriminated against because he has filed any complaint or instituted <br /> any proceeding under or relating to the labor standards applicable hereunder <br /> to his employer. <br /> (i) Assi.Viliient. The APPRAISER'S rights, obligations, and duties under <br /> this agreeFiktshall not be assigned in whole or in part, but this shall not <br /> prohibit the assignment of the proceeds due under this agreement to a bank or <br /> financial institution, This agreement may be assigned by the Agency to any <br /> corporation, agency, or instrumentality having authority to accept the assignment. <br /> (j) Yeee_11l 'actin . None of the work or services covered by this agreement <br /> shall be subcontracted without the prior approval of the COUNTY, <br /> (k) Records. The APPRAISER shall maintain records of all details with respe <br /> to the services to be performed under this agreement, including one complete copy <br /> of each appraisal report and related notee, for three (3) years after delivering <br /> the report or until the property is acquired by the COUNTY or the acouisition is <br /> abandoned, whichever is later, <br /> (I) Affidays_...21C.------ornpliance.
