(b) The Attorney will, within one year from the date of the original <br /> Certificates, at the request of the Agency, make continuations of <br /> their examinations of the title with respect to each parcel and <br /> will furnish written supplemental reports of title in triplicate <br /> continuing such original Certificates to Later dates. <br /> (c) If it becomes necessary to examine the titles of adjoining <br /> property comers or the titles of property owners where their <br /> prescriptive rights to streets within the project area are <br /> affected, a fee for such shall be included in the cost of the <br /> adjoining properties. <br /> (d) Upon completicn of the acquisition of the above described area <br /> by the Agency, the Attorney will, if requested by the Agency, <br /> furnish a final Certificate of Title in triplicate with respect <br /> to the entire area. <br /> (e) For each condemnation case appealed, in addition to other compen- <br /> sation, a reasonable ccmpensation to be agreed upon depending upon <br /> the services rendered. <br /> 6. MaxinunCompensatimPayable. The County shall compensate the <br /> Attorney for the services rendered under this agreement an the following <br /> basis: <br /> (1) For the basic services described herein, the Attorney shall <br /> receive total maximum compensation not to exceed $19,200 (120 parcels, <br /> $160. per parcel for each parcel acquired by direct purchase) except in <br /> the event eminent domain proceedings are necessary. A, umitten addendum <br /> to increase the maximum compensaticn payable shall be approved by the <br /> CD Director and manager whereby the Attorney would receive $400.00 <br /> per parcel for each parcel acquired through eminent domain proceedings. <br /> (a) The term "Parcel" as used herein means any contiguous tract <br /> of land in the same ownership whether such tract consists of one or <br /> more platted lots or a fractional part thereof. <br /> 7. Time of Performance. Title will be examined and preliminary opinions <br /> will be furnished on all parcels within Thirty (30) working days of notice <br /> to proceed. <br /> 8. Termination for Breach. In the event of any breach of any condition <br /> or provision hereof, the Agency shall have the right, by prior written notice, <br /> to terminate the Attorney's employment hereunder and cancel this contract and <br /> have the work called for hereby otherwise performed, without prejudice to any <br /> other rights or remedies of the Agency. The Agency shall have the benefit of <br /> such work as may have been completed up to the time of such termination or <br /> cancellation, and with respect to any part which shall have been delivered to <br /> and accepted by the Agency there shall be an equitable adjustment of compensati <br /> -4- <br />
