Accordingly, the following <br /> is proposed: <br /> PERMIT FEE REFUND POLICY <br /> Fees for permits issued for construction which does not start shall not be <br /> refunded unless the applicant can show verifiable hardship. North Carolina <br /> State law states building permits expire after six months if no construction <br /> has begun. No fees shall be refunded for permits that fall within this <br /> • -- category. Application for a refund must be made within six (6) months'' <br /> of the date of issuance of the permit, and be accompanied by the permit. <br /> The application shall give reason or show cause that there is a hardship- <br /> Proofmust be given that no work has begun on the project. The service <br /> charge retained by the County shall be either twenty dollars or 20% of <br /> the original fee or the smaller of these. <br /> Hardship cases are analyzed by examining personal hardship, natural disaster, <br /> hardship caused by the government, or hardship caused by the individual . <br /> When a hardship is caused by the death of a family member, sickness of the <br /> applicant, a natural disaster, such as hurricane or flood, or for other <br /> reasons not caused by the applicant, the fee will be refunded. Other <br /> reasons not caused by the applicant may include actions taken by Orange <br /> County which render construction impossible or impractical when the <br /> applicant has made application in good faith reliance on the state of things <br /> before the precipitating action. <br /> IMPACT: Approval of a policy would permit administrative action to be taken <br /> on three cases that are pending. In all three cases building permits <br /> were revoked by the County pursuant to Article 11 '3 of the Zoning Ord- <br /> inance which provides for review and a ruling by the zoning office con- <br /> cerning revocation'of previously issued building permits for non-con- <br /> ' forming projects underway at the time of Zoning Ordinance adoption, <br /> RECOMMENDATION: <br /> 1) Adopt the policy; <br /> 2) Authorize the Planning Department to make refund when eligible under <br /> the policy. <br />
