It is located in Eno Township off of Old NC 10. <br /> The proposed division is on an existing Class 3 private road which once <br /> was a main road between Durham and Hillsborough -(Old Hillsborough Road, <br /> Old Durham Road, oric-inally Old NC 10, or Old US 70). The applicant <br /> can not obtain a right of way from Southern Railroad "other than that <br /> which presently exists". The applicant purchased a triangular Section <br /> of land and obtained a 30 foot right of way between Old NC 10 and the <br /> railroad. A 60 foot right of way exists between the subdivision and <br /> railroad. <br /> The present road exists within the right of way which is used by 4 <br /> existing dwellings. The subdivision meets the other minimum zoning <br /> and subdivision requirements. This area is designated arm]. Residential <br /> by the adopted Land Use Plan. <br /> Planning acard recommends approval. <br /> 7.-PACTS: A private road presently serves this area. Approval would ensure right <br /> of way maintenance of the road from the subdivision to Old NC 10, This <br /> scale development is appropriate in this area according to the Land Use <br /> Plan. <br /> Recommendatico(s): Approval as requested, <br />
