Kirk responded affirmatively. <br /> Kizer moved approval of the subdivision. Laszlo seconded. The <br /> motion carried. Opposed: Cleary. <br /> Agenda Item #5 C.M. Mayse Estate Subdivision. <br /> Kirk gave a presentation on the C.M. Mayse Estate Subdivision. <br /> Mr. Mayse indicated that the land could not be sold except to <br /> other heirs as specified in the Will. Cleary clarified that the <br /> purpose of the subdivision was to meet the specifications of the <br /> Will and for tax purposes. <br /> Shanklin moved approval of the subdivision with a Class C road. <br /> Lansford seconded. The motion carried unanimously. <br /> Agenda Item #6 Roy C. Felon Subdivision. <br /> Kirk gave a presentation on the Roy C. Belton Subdivision. Re noted <br /> that the lot was sold by deed and never went through the subdivision <br /> process. Cannity added that the individual could only obtain a <br /> 30 foot right of way and therefore could meet the Subdivision <br /> Regulations except with the partial right of way. <br /> Cleary asked what type of road was recommended. Staff indicated <br /> that a Class B road was recommended. Kizer indicated it was a <br /> trade off between a Class B road and allowing a 30 foot right of way. <br /> Cleary motioned approval of the subdivision with a partial 30 foot <br /> right of way. Kizer seconded the motion. <br /> Gordon cited the letter from Carrboro. Cannity indicated Carrboro <br /> failed to recognize it was also in the University Lake watershed. <br /> Cannity noted that in the Staff's view the road was a public road. <br /> Cleary asked for clarification on this point. Cannity responded <br /> that the deed line was also the edge of the right of way and <br /> constituted a motion toward public dedication. He added the <br /> subdivision was drawn in 1949 and recorded in 1956. <br /> The Board discussed combining the 2 issues of subdivision approval <br /> and road improvement requirements. General discussion followed <br /> regarding public, private and non-state maintained roads. <br />
