3 <br />Development Process, Schedule, and Action <br />• First Action: Neighborhood Information meeting held on October 18, 2006. <br />• Second Action: Concept Plan approved by the Planning Board on November 1, 2006 with <br />the following conditions: <br />1. The intersection and road alignments on the Preliminary Plan shall be approved by <br />NCDOT office in Graham. <br />2. Homeowners Association documents that provide for maintenance of the Open Space <br />shall be submitted with the preliminary plan. Provisions shall be included in the <br />Homeowners Association documents that would prohibit tree cutting in the roadside Open <br />Space except for maintenance purposes. <br />3. Show proposed dedication of an additional 5 feet of right-of-way, or 35 feet from C/L of <br />existing R/W, whichever is greater, along Kerley Road on the Preliminary Plan. <br />4. Show easement location of subdivision sign on Preliminary Plan. <br />5. Any street lighting in Orange County shall be approved by Planning Department prior to <br />installation. <br />6. A traffic study shall be prepared and submitted with the Preliminary Plan that indicates <br />traffic patterns and traffic flows on Kerley Road. This study will be reviewed by the <br />Orange County Planning Staff to determine whether turn lanes are warranted on Kerley <br />Road. <br />• Third Action: Planning Board considered the Preliminary Plan on February 7, 2007. The <br />Planning Board determined that the conditions on the Concept Plan had been addressed and <br />unanimously recommended approval. <br />• Fourth Action: <br />4 1. The Board shall consider the application within a reasonable amount of time. <br />2. If the Preliminary Plan is approved by the County Commissioners the applicant shall have <br />one (1) year to prepare and file a Final Plat or to request a one-year extension from the <br />Planning Director. <br />RECOMMENDATION(S): Administration Recommends Approval, in accordance with the <br />attached Resolution of Approval. <br />Planning Board Recommends Approval, in accordance with the <br />attached Recommendation which corresponds with the Resolution of <br />Approval. <br />Planning Staff Recommends Approval, in accordance with the <br />attached Resolution of Approval. <br />
