341 <br /> ORANGE COM•TTY PLANNENTG DEPARTMENT <br /> prIT.TABOROTTGEC <br /> NORM CaROLMA. <br /> 27275 <br /> (4204 <br /> .1,44 <br /> REMO <br /> TO: Orange County Planning,Board <br /> FROM: Orange County Planning Staff <br /> DATE: July 16, 1981 <br /> RE: Subdivision of Property of Elizabeth Pegg Latta <br /> The Orange County Subdivision Regulations allow the Planning Staff to approve <br /> minor subdivisions (see III-C) provided that no more than four (4) new lots are <br /> created out of a tract. The lot of record would be the configuration of lots as <br /> of March 13, 1978. It is the Staff interpretation that divisions of a lot of record, <br /> after 1978, whether through the minor subdivision process or through a process <br /> exempt from subdivision regulation effects the nimher of Lots that may be created. <br /> This particular tract was divided to create an 11 + acre tract after March. 1978 <br /> The buyer of the remainder non wishes to create five (5) additional tracts. An <br /> Interpretation other than the above would allow individuals to use the minor sub- <br /> division process and avoid the scrutiny of the major subdivision process. <br /> It is the Staff's recommendation that this subdivision be considered a major <br /> rather than a minor as reauested by the developer. <br /> /nsw <br />
