n96 <br /> DRAFT 3 <br /> and that the Staff prepare another amendment to conform the line in <br /> Transition Area I to the center line of Old Highway 86. <br /> Collins stated that the reason the Planning Directors are <br /> resistant to shifting lines is that shifting the lines and taking land <br /> from one jurisdiction results in the jurisdiction losing land wanting <br /> compensation by acquiring land elsewhere. This means that the lines would <br /> be shifting back and forth so as to prevent one jurisdiction from <br /> obtaining more land area than the other. <br /> MOTION AMENDED <br /> Chr s Best amended the motion to include that the Staff must be <br /> asked to help prepare an amendment -- that the residents of Fox Meadow <br /> should initiate the action and request help from the Planning Staff. <br /> Barry Jacobs indicated that the residents from Fox Meadow did <br /> attend the public hearings but were drowned out by Calvander residents. <br /> Collins stated that the line was never on the plan that went to <br /> public hearing. The line has always been stated in the agreement only. <br /> Steve Yuhasz stated that the line has not been set in stone and <br /> he feels Orange County has some flexibility in shifting the line since <br /> Carrboro has not been involved in the agreement until now. <br /> Peter Kramer disagreed with the motion as stated, since the <br /> citizens of Fox Meadow may at any time petition for a change in the line. <br /> MOTION RESTATED <br /> Barry Jacobs restated his motion. If the residents of Fox <br /> Meadow are interested in submitting a petition, that the staff assist them <br /> in preparing the appropriate amendment to the map and the Joint Planning <br /> Agreement. <br /> Marvin Collins clarified that if a petition is submitted which <br /> clearly states the problem and how the problem may be solved, the Planning <br /> Staff's responsibility would be to work with them in submitting this <br /> request to the respective boards. <br /> SUGGESTED MOTION <br /> Betty Margison suggested that in response to the concerns voiced <br /> by the residents of Fox Meadow, that a letter be sent from the Planning <br /> Board and Planning Director saying that the Board is aware of their <br /> concerns and should they petition at a future time, the Planning Staff is <br /> available to assist them. Peter Kramer asked that the reasons for not <br /> recommending a change in the line also be stated in that same letter. <br /> ORIGINAL MOTION WITHDRAWN <br /> Barry Jacobs w thdrew his motion. <br /> MOTION <br /> Jacobs restated the motion as made by Betty Margison and amended <br /> by Peter Kramer: "The Planning Board recommends approval of the Staff <br /> recommendation with the addition that the Planning Director and the Plan- <br /> ning Board Chair send a letter to the residents of Fox Meadow expressing <br /> the Board's willingness to work with them if they wish to pursue an <br /> amendment to the line under the rules of the Joint Planning Agreement. <br /> Seconded by Chris Best. <br />
