DRAFT095 095 <br /> when the line was first established several years ago it was at a time <br /> when Fox Meadow was in the very first stages of development and just <br /> because development occurred on one side of the road or the other was no <br /> basis for shifting the line. Another reason was that Carrboro agreed to <br /> come up with an agreement that Fox Meadow Subdivision would not be annexed <br /> involuntarily for a period of at least ten years. <br /> On October 20, 1987 Carrboro Board of Aldermen adopted the <br /> proposed Joint Planning Agreement and a Resolution of Intent to delay <br /> consideration of annexing Fox Meadow Subdivision for a period of ten <br /> years. <br /> On October 26, 1987 Chapel Hill Town Council adopted the pro- <br /> posed Joint Planning Agreement. <br /> Collins recommended approval of the Joint Planning Agreement as <br /> presented at the October 14, 1987 public hearing, including the technical <br /> corrections recommended by the County Attorney. He recommended holding <br /> off on the adjustment of the line boundary along Hillsborough Road, since <br /> the map was not subject to change at the public hearing. He proposed <br /> considering a possible adjustment at some later date as well as reviewing <br /> the northern boundary line of Transition Area II, particularly as it <br /> relates to Duke Forest. The one lot depth setback from the Forest results <br /> in a very erratic line. <br /> Betty Margison asked if there were any roads to the west of Fox <br /> Meadow that could connect to the development. Collins stated there were <br /> no roads in the area other than Old NC 86. <br /> Margison expressed concern that all 56 families in Fox Meadow <br /> want the line changed. <br /> Collins stated that changing the line could mean that anyone who <br /> wants to be in one jurisdiction or another could just voice opposition and <br /> the line would be changed. In his opinion, that is not sufficient <br /> justification to shift the line. The line was initially established by <br /> members of the governing boards of Chapel Hill and Orange County prior to <br /> the development of the Fox Meadow subdivision. <br /> In response to a request from Chris Best, Collins explained the <br /> different notations on the Joint Planning Area map. Best asked about the <br /> control that Carrboro would have over the Fox Meadow area. Collins stated <br /> that if the agreement is officially adopted and signed by all three <br /> jurisdictions, that before Carrboro and Chapel Hill can take over the <br /> administration of their ordinances within designated Transition Areas, <br /> they have to prepare zoning plans that are consistent with the Land Use <br /> Plan. The towns would also have to submit the zoning plans as well as <br /> their Land Development Ordinances to the County for adoption by reference. <br /> Once this is done, they take over administration, approving Special Use <br /> Permits and major subdivisions, with the County maintaining the right of <br /> courtesy review. <br /> Collins indicated that administrative procedures need to be <br /> worked out between the three jurisdictions which would outline the number <br /> of public hearings, when amendments to the Joint Planning Agreement would <br /> be heard, etc. <br /> In answer to a question from Chris Best about the procedure that <br /> Fox Meadow would follow in requesting a change of the line, Collins <br /> indicated that a petition would need to be filed, and the Planning Staff <br /> would work with them to prepare an amendment. <br /> MOTION <br /> A motion was made by Barry Jacobs, seconded by Betty Margison, <br /> that if the agreement is approved that the Planning Board recommends that <br /> Staff be directed to assist the people of Fox Meadow in preparing a Land <br /> Use Plan amendment for the next appropriate Joint Planning Public Hearing <br />
