Vest Ma r. greet <br /> IC. . �. •.±r:_a.;.. .r..r 9 North Ca O ra 2'51 <br /> 0 <br /> (919, 96 6-770 c�4.V - <br /> The following resolution was introduced by Alderman Judith Wegner <br /> and duly seconded by Alderman John Boone. <br /> A RESOLUTION OF INTENT TO DELAY <br /> CONSIDERATION OF ANNEXING THE FOX MEADOW SUBDIVISION <br /> Resolution No. 21/87-88 <br /> WHEREAS, Orange County, Chapel Hill and Carrboro have <br /> executed a Joint Planning Agreement wnich establishes a method of <br /> coordinated and comprehensive planning in the Orange County- <br /> Chapel Hill-Carrboro Joint Planning Area; and <br /> WHEREAS, Section 3 .2 of the Joint Planning Agreement <br /> entitled, "No Annexation By One Town Into Another Town' s <br /> Transition Area" provides by mutual agreement areas appropriate <br /> for annexation by each respective town; and <br /> WHEREAS, the residents of the Fox Meadow subdivision on <br /> October 14, 1987 submitted a petition and appeared <br /> before the Orange County Board of Commissioners, ChapelpHillnTown <br /> Council, and Carrboro Board of Aldermen meeting jointly to <br /> conauct a public hearing on the Joint Planning Agreement; and <br /> WHEREAS, the residents of the Fox Meadow subdivision <br /> requested that their property be included within the rural buffer <br /> or if it remained within the transition area, that they would <br /> disfavor possible annexation by the Town of Carrboro but would <br /> instead prefer possible annexation by the Town of Chapel Hill . <br /> NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF <br /> THE TOWN OF CARRBORO: <br /> Section 1. The boundary separating the Carrboro Joint <br /> Development Review Area and the Chapel Hill Joint Development <br /> Review Area is located properly. <br /> Section 2. That the inclusion of the Fox Meadow subdivision <br /> as part of the Rural Buffer would not be a logical extension of <br /> the rural buffer due to the degree of nonconformity created with <br /> the Joint Planning Area Land Use Plan and Agreement. <br /> Section 3. That the Town of Carrboro does not intend to <br /> annex 'through involuntary means the Fox Meadow subdivision, <br /> Phases 1-4 as , approved by the Oran e <br /> Commissioners, within ten years of the date ofCthisyresolutiion.°f <br /> Section 4. This resolution shall become effective upon <br /> adoption. <br />
