m ir <br /> 073 MEMORANDUM OF UNDERSTANDING <br /> WHEREAS, the State of North Carolina, hereinafter referred to as "the <br /> State", owns 1 ,354.27 acres known as the Eno River State Park, <br /> hereinafter referred to as "the Park", and has delegated management <br /> responsibilities for the Park to the N. C. Department of Natural <br /> Resources and Community Development (Division of Parks and Recreation ) , <br /> hereinafter referred to as "NRCD" ; and <br /> WHEREAS, NRCD, in 1979, finalized the Master Plan for the Park which <br /> prescribes the land acquisition, facility development and management <br /> goals for the Park; and <br /> WHEREAS, urban development is encroaching on the Park and has the <br /> potential for adversely impacting the Park ' s important natural and <br /> recreational resources ; and <br /> WHEREAS, the County of Orange, hereinafter referred to as "the County", <br /> has the ability to manage urban development adjacent to the Park <br /> through its comprehensive land use planning, zoning and enforcement <br /> authorities; and <br /> WHEREAS, NRCD and the County are strongly committed to the development <br /> and implementation of land use and zoning policies to protect the - <br /> natural and recreational values of the Park. <br /> NOW, THEREFORE , BE IT RESOLVED THAT: <br /> 1 . The County in consultation with NRCD, will zone the Park to a <br /> classification that will allow for the ` continuation of current <br /> Park uses and for the implementation of the 1979 Master Plan for <br /> the Park; <br /> 2. The County herewith accepts the 1979 Master Plan as adopted by <br /> NRCD and finds that all uses and recommendations outlined therein <br /> are deemed to be permitted accessary uses as defined by the zoning <br /> and development codes of the County; <br /> 3 . The County, in consultation with NRCD, will develop a <br /> comprehensive land use plan for areas surrounding the Park which <br /> would recommend mechanisms to protect and buffer the Park and its <br /> natural and recreational resources; <br /> 4. The County will establish zoning districts adjacent to park bounda- <br /> ries which would offer the maximum protection for the Park and its <br /> natural recreational resources; <br /> 5. Only after careful study and consideration of and after consulta- <br /> tion with NRCD will the Board of County Commissioners act on <br /> rezoning petitions for private properties proposed for the Park <br /> acquisition as defined in the 1979 Master Plan for the Park; <br /> 6. The County will establish zoning and land use policies that <br /> provide a smooth transition in uses from low density residential <br />
