2050 <br /> State Standards, would not be accepted by the <br /> State for maintenance due to density or some <br /> other State requirements that the subdivision <br /> cannot meet. <br /> EVALUATION <br /> In applying these conditions to Ram ' s Woods, the <br /> Planning Department notes the following : <br /> 1 . The proposed subdivision is located adjacent to the <br /> right of way of SR 1131 which is unpaved. However, <br /> NCDOT has commented that the road should not be <br /> considered as an extension of the State road. <br /> 2. a) The subdivision consists of less than ten ( 10 ) <br /> lots. <br /> b ) The subdivision preserves a natural area <br /> through a system of common open space as a <br /> feature of the cluster design . <br /> c) The subdivision does not include or abut any <br /> part of a thoroughfare or street shown on the <br /> Orange County thoroughfare plan or on the <br /> thoroughfare plan of an Orange County munici- <br /> pality. It does not lie within a designated <br /> transition area determined by the County. <br /> d ) The subdivision does not extend an existing <br /> subdivision where the road is private or <br /> unpaved. However, access to Ram ' s Woods is <br /> via an unpaved State road. The proposed road <br /> is not an extension of SR 1131 . <br /> e) If constructed to State standards, the road <br /> would be accepted for maintenance by NCDOT. <br /> RECOMMENDATION <br /> The evaluation of the proposed road in this subdivision <br /> indicates that a public road should be required. <br /> The subdivision satisfies three of the six conditions <br /> for the designation of a private road. The nature and <br /> location of the subdivision does not in itself Justify <br /> private road status. The subdivision does not meet condition <br /> d, extension of an existing subdivision, and condition e, <br /> NCDOT acceptance. NCDOT density requirements for acceptance <br /> call for at least four (4) developed parcels on a cul -de-sac. <br /> When fully developed, this subdivision will have seven (7 ) <br /> developed parcels. <br /> The Planning Staff recommends that Ram ' s Way be dedi- <br /> cated public and constructed to State standards. <br />
