242 ;` : <br /> 19 <br /> Residential -1 with an overlay district of Protected <br /> Watershed II in the Seven Mile Creek Watershed. Adjacent <br /> land uses include the railroad, utilities, and industry. <br /> The request has been made for rezoning to Community <br /> Commercial - II1 . <br /> The Planning Staff recommends against rezoning of the <br /> property from Residential -1 to Community Commercial III . <br /> The property is located in a Protected Watershed 11 overlay <br /> district and is proposed for non-residential use. A planned <br /> development approach, including site plan approval and the <br /> issuance of a Special Use Permit, provides better control <br /> over such development in a watershed . <br /> The Board of Commissioners will consider the proposal for <br /> decision on October 5 , 1987 . <br /> Jacobs asked how the surrounding properties in the area are <br /> zoned . Szymik responded that property to the east <br /> Orange/Alamance Water Authority is zoned Office- <br /> Institutional , to the west Hancor is zoned Existing- <br /> Industrial and Public Service is not zoned - it is a public <br /> utility . <br /> FINDINGS OF FACT. <br /> MOTION : Best moved positive findings on Article 20 (Specific <br /> Standards) . Seconded by Taylor. <br /> VOTE: Unanimous . <br /> MOTION: Yuhasz moved positive findings on Article 4 .2 (Application <br /> Criteria) . Seconded by Swann . <br /> VOTE: Unanimous. <br /> MOTION : Best moved to accept Planning Staff ' s recommendation for <br /> denial of the rezoning request. Seconded by Pilkey. <br /> Kramer asked what requirements Staff would recommend for a <br /> planned development. Szymik responded that buffer require- <br /> ments were set by the Ordinance and landscaping requirements <br /> could vary. The site plan would require management of the <br /> first one-half inch of runoff . Kramer continued asking the <br /> current status of the site and Szymik responded that It Is <br /> currently undeveloped. <br /> Yuhasz commented that it seems to be the policy of the Board <br /> of Commissioners to zone commercial only where commercial <br /> already exists, i .e. , there is no undeveloped commercial <br /> land available. <br /> VOTE: 8 in favor . <br /> 2 opposed (Boland - indicated everything surrounding this <br /> property is commercial , Yuhasz - indicated he felt it is a <br /> bad policy to require that commercial rezoning be a planned <br />
